Our general terms and conditions are divided into 2 sections:
- User terms. These applies to the visitors and users consuming the videos and possibly
supporting creators with payments.
- Creator terms. These apply to the creators who publish video content to be consumed by the users.
The present document relates to the the User terms
By creating an account, viewing videos, making a purchase, or otherwise visiting or
using our Services, you accept this Agreement and consent to contract with us electronically.
If you are an entity other than a natural person, the person who registers the account or otherwise uses our
Services must have the authority to bind the entity. In this context, “you” means both the entity and each
person who is authorized to access the account.
We may update this Agreement by posting a revised version on our website. By continuing to use our Services,
you accept any revised Agreement.

2. Our Services
Subject to the terms hereof, we grant you access to our Services. This includes
- Content creator landing pages.
- Video streaming. Includes
- Multiple video file encoding for different client devices
- Web player
- Video paywall. Includes
- Complete user paywall service with authentication, payment, viewing of videos.
- Payment systems to support and tip content creators.
Registration. You may create an account to use certain features we offer. To do so, you must
provide an email address, or connect using a social network account. By creating an account, you agree to receive notices from Ubacast
at this email address.
Account Security. You are responsible for all activity that occurs under your account, including
unauthorized activity. You must safeguard the confidentiality of your account credentials. If you
are using a computer that others have access to, you must log out of your account after each
session. If you become aware of unauthorized access to your account, you must change your
password and notify us immediately.
4. Video streaming
You can browse the ubacast.com website and view the video content available, using our embedded video player. You do
not need to be logged into an account in order to view free video content.
You are never authorized to try to download the video files, encode the videos, screen capture the videos, try to save
or reproduce the content in any ways. You should only be accessing the video streams using an internet connection
and using our video player on one of our websites.
Video streaming content is only available for private consumption. It cannot be broadcasted or shared for example to
an audience outside of your private circle.
The video streams are encoded in different formats. Depending on your internet connection, on the type of device you use,
or on the video source quality, different bandwith charges may occur. These charges are all upon yourself the User.
6. Creator donations
We allow users to make donations to content creators. You don't need to connect to your account for this.
We do ask for contact name and email for billing purposes for donations. Email is only communicated to
the creator if purposely accepted by the user in the purcahse form.
If the user connect to his account before making donations, he will be able to come back to his account
and manage previous donations.
All donations are final, and we do not refund donations.
7. Acceptable Use Policy
7.1 Copyright Policy
All the content available on ubacast.com is protected by author rights, tademarks and the intellectual property of their
creator and producers.
If you believe that your work has been copied in a way that constitutes copyright infringement, please provide Ubacast
written proof by contacting us at email@example.com.
7.2 Code of Conduct
In using our Services, you may not:
- Use an offensive screen name (e.g., explicit language) or avatar (e.g., containing nudity);
- Act in a deceptive manner or impersonate any person or organization;
- Harass or stalk any person;
- Harm or exploit minors;
- Distribute “spam” in any form or use misleading metadata;
- Collect personal information about others;
- Access another’s account without permission;
- Engage in any unlawful activity;
- Embed our video player on or provide links to sites that contain content prohibited by Section 5.2; or
- Cause or encourage others to do any of the above.
7.3 Prohibited Technical Measures
You will not:
- Except as authorized by law or as permitted by us: scrape, reproduce, redistribute, create derivative
works from, decompile, reverse engineer, alter, archive, or disassemble any part of our Services; or
attempt to circumvent any of our security, rate-limiting, filtering, or digital rights management
- Submit any malicious program, script, or code;
- Submit an unreasonable number of requests to our servers; or
- Take any other actions to manipulate, interfere with, or damage our Services.
In case of fraud suspicious or malicious activity from your account or user sessions, we reserve the right to
block your account and IP address.
8. Term and Termination
This Agreement begins when you first use our Services and continues so long as you use our Service or
have an account with us, whichever is longer. Ubacast may terminate this Agreement at any time by
providing thirty (30) days’ written notice, and users may terminate at any time by deleting their accounts.
If you breach this Agreement, Ubacast may, at its option: (a) terminate this Agreement immediately, with or
without advance written notice; (b) suspend, delete, or limit access to your account or any content within
it; and (c) to the extent permitted by applicable law, retain any amounts payable to you (which you forfeit).
If Ubacast deletes your account for breach, you may not re-register.
In the event of any termination or expiration, the following sections will survive: Section 7.2
(Indemnification), Section 9 (Disclaimers), Section 10 (Limitation of Liability), Section 11 (Disputes,
Arbitration, and Choice of Law), and Section 12 (General Provisions).
